8. Governing Law

Any claim relating to DesignPac’s web site shall be governed by the laws of the State of California without regard to its conflict of law provisions. General Terms and Conditions applicable to Use of a Web Site.

9. Fees & Refunds

You agree to pay the fees, in such amount and for such billing frequency as specified during registration, in full prior to any obligation of DesignPac to perform under this Agreement. You further agree that, upon registering for the services through the Site, you authorize DesignPac to charge your method of payment (e.g. credit card) for the fee on monthly basis. Payment of the fees shall be in such amounts and at such times as set forth by DesignPac through information provided to you and as authorized through the sign-up and registration process.  You represent and warrant to DesignPac

You may cancel your subscription with us at any time. Upon cancellation, you will continue to have access to the DesignPac services through the end of the then current month. DesignPac may change its fees from time to time by posting the changes on the Site with 7 days’ prior notice, but with no advance notice required for temporary promotions or reductions in fees.

You can request a full refund excluding the applicable transaction fees in respect of a purchase of any subscription plan if:

• You did not use the service.
• You did not like our service.
• You did not like the artwork we created.

After 7th day, there are no refunds for partial subscription plans under any circumstance, including cancellations and unused time(inactivity) on a plan. Upon cancellation you will have access to our service for the length of your current billing cycle.

10. Ownership & Trademarks of Work

You retain ownership of all graphics and files created by DesignPac during any month in which your membership subscription is paid in full. If you provide DesignPac with materials or assets, you agree that these materials are approved to be used in your designs and are not owned or trademarked by any other parties. You are solely responsible to affirm that any materials provided can be legally used in design work for your entity. Should a license or trademark issue arise, DesignPac is not liable for the materials you provide.

11. Abuse of Service

DesignPac is designed for the reasonable use of an average non-creative based small business or individual. If we find that you are abusing our service, reselling our work as your own, using our services for illegal, adult/pornographic or a use that goes against our company philosophy, culture and morals, we reserve the right to cancel your account at any time.

12. Work Samples

We reserve the right to publish your work in our portfolio, social media or other communication efforts. If there are items that you wish to remain private or confidential please let us know when you request the task.

13. Confidentiality

DesignPac promise to keep all business matters regarding your business and brand confidential. We will communicate with only approved employees from your company. We never share any information publicly, other than work samples as outlined in “WORK SAMPLES” above.
